Why should I make a will?

  • If my children are orphaned, they could have social workers or an unwanted relative as their guardian
  • Inadequate tax planning could mean the Inland Revenue receive money that my family should have
  • My spouse will not necessarily inherit everything I own

Making a will ensures complete peace of mind that your family's inheritance is established. You will know that your hard earned assets will pass to the people you choose rather than descending according to the strict rules of Intestacy set by the Government.

Our home visit service allows you to give instructions for your will with the maximum of ease. Our partner will call on you at home to take your instructions. We appreciate that many people's working days cannot be interrupted and to take account of this we usually see clients in the evenings or at weekends. We will discuss your requirements in the comfort and security of your own living room. When the documents have been prepared, we will return to make certain that signing and witnessing are completed correctly.

THE PROTECTIVE TRUST WILL

  • Developed to meet the needs of couples who own or are buying their own home jointly.
  • Designed to protect each individual's share in the property for the ultimate benefit of the children or beneficiaries, whilst allowing the surviving partner all the continued rights, benefits of occupation and control over the whole property for the remainder of their lifetime.
  • Protects the value of your share in the property (after your death) from being used to pay the care bills of your surviving partner if they should require permanent residential care in the future, thus ensuring that your children will eventually receive at least your share in the value of the property.
  • Particularly suitable for:
    • Mature couples who are concerned about the effects of The Community Care Act 1990
    • Couples where one or both partners have children from a previous relationship or where there exists a significant age difference.
    • Couples who wish to ensure their children receive an inheritance but without affecting the residential rights of their partner.
