Partners but not married to each other?
Bringing up your children?
Mother
- legally you have Parental Responsibility
Father - you do not have Parental Responsibility automatically
Unmarried Fathers have no legal involvement in:
- Decisions on schooling and education
- Medical treatment (approval for operations)
- Provision and location of the home environment
- Appointment of guardians
- Adoption; if that is the Mother's wish
- Punishment following misbehaviour!!
An unmarried Father has no automatic rights to 'Guardianship' if the child's Mother dies. The Mother must appoint the Father as Guardian in her Will.
How can the unmarried Father acquire Parental Responsibility?
- By subsequent marriage to the Mother; or
- By being appointed Guardian in the Mother's Will if she dies; or
- By formal agreement with both signatures witnessed by the Court. (Legal Systems can assist you)
- Through the terms of the Adoption and Children Act 2002
